(7) Discussions, deliberations, votes, or other final action on matters related to the City’s competitive activity, including information that would, if disclosed, give advantage to competitors or prospective competitors and is reasonably related to one or more of the following categories of information:

generation unit specific and portfolio fixed and variable costs, including forecasts of those costs, capital improvement plans for generation units, and generation unit operating characteristics and outage scheduling;
bidding and pricing information for purchased power, generation and fuel, and Electric Reliability Council of Texas bids, prices, offers, and related services and strategies;
effective fuel and purchased power agreements and fuel transportation arrangements and contracts;
risk management information, contracts, and strategies, including fuel hedging and storage;

	a.	2019 Capital Improvement Program Budget Amendment No. 3 Council is requested to consider the 2019 Capital Improvement Program (CIP) to appropriate $281,268 for two replacement Stormwater Dump Trucks, $163,879 for one new, additional EWS - Disposal Roll-Off Truck, $277,170 for one replacement EWS - Delivery Commercial Front-Load Truck, $323,168 for Central Park Restroom Building and $2,365,000 for Winters Park Sports Field Lighting. 	b. 	c.	Bond Refunding - General Obligation Commercial Paper Notes & Certificates of Obligation Council is requested to consider authorizing staff to refund approximately $23.5 million of General Obligation Commercial Paper Notes, Series 2015 and approximately $1.3 million Combination Tax and Revenue Certificates of Obligation, Series 2010 with General Obligation Refunding Bonds, Series 2019. 	d.	Bond Refunding - Electric Utility System Commercial Paper Notes & Revenue Refunding Bonds Council is requested to consider authorizing staff to refund approximately $41 million Electric Utility System Commercial Paper Notes, Series 2018, approximately $8 million of Electric Utility System Revenue Refunding Bonds, Series 2011A and approximately $114 million of Combination Tax and Electric Utility System Revenue Refunding Bonds, Series 2010 with Electric System Revenue Refunding Bonds, Series 2019A. 	e.	Texas Department of Transportation (TxDOT) Selective Traffic Enforcement Program (STEP) 2019 Comprehensive Grant Council is requested to consider accepting a Texas Department of Transportation (TxDOT) – Selective Traffic Enforcement Program (STEP) – Comprehensive Grant. Unless otherwise directed by Council, this item will be scheduled for formal consideration at the September 17, 2019 Regular Meeting.

3.		Verbal Briefings:

	a.	IH 635 East Update Staff, TxDOT and others will provide an update on reconstruction and related economic development opportunities related to the reconstruction of IH 635.

	b.	Transportation Update The Transportation Director will provide an update on recent developments regarding advancing the IH 635 East Project, SH 78 and I-30, and other transportation related issues.

	c.	Program Management Services Contract A Program Management Services contract is scheduled for consideration at the September 17, 2019 Regular Meeting. Staff will brief the Council on the Program Management Methodology and specifics of the contract.

	d.	Neighborhood Vitality Matching Grant Update Staff will provide an update to City Council regarding the 2019 Neighborhood Vitality Matching Grant Cycle 1 applications.

	e.	Discuss Zoning File No. Z 19-08, K1 Concept, LLC (District 2) The City Council postponed zoning File No. Z-19-08, requesting approval of a Specific Use Provision for the retail sale of used goods at 1725 South First, for further discussion including possible SUP conditions.

	f.	Administrative Services Committee Update Robert Smith, Chair of the Administrative Services Committee, will provide a committee report on the following item: Information on a proposed Uniform Election Date for officers of all boards and commissions.

BACKGROUND
(1) Two Replacement 12-Yard Dump Trucks for Stormwater Maintenance Stormwater Management requested two replacement 12-Yard Dump Trucks in the 2018 CIP (2018 CIP - Page M20), and a PO was issued in June 2018. That vendor was no longer authorized to sell this particular dump truck on BuyBoard, so the PO established in June 2018 was canceled. The funding approved in the 2018 CIP has not been spent. On June 18, 2019, City Council authorized the purchase of the two 12-Yard Dump Trucks through a Purchasing Report. Staff seeks an amendment to the 2019 CIP, providing for the supplemental appropriation of $281,268 in the Stormwater Maintenance Equipment capital project. (2) New Roll-Off Truck for EWS - Disposal Environmental Waste Services (EWS) - Disposal requested one new, additional, fully-functional roll-off truck to continue operating the convenience center at Hinton Landfill in ways that will keep up with the volume of waste. On July 16, 2019, City Council authorized the purchase of one new, additional roll-off truck through a Purchasing Report. Staff seeks an amendment to the 2019 CIP, providing for the appropriation of $163,879 in the New Landfill Roll-Off Truck capital project. (3) One Replacement Commercial Front-Load Truck for EWS - Delivery EWS - Delivery requested the unscheduled replacement of one Commercial Front-Load Truck due to an accident that resulted in a total loss of the vehicle. On July 2, 2019, City Council authorized the purchase of a replacement of one commercial front-load truck through a Purchasing Report. The Self Insurance Fund will transfer $38,000 to the CIP for the replacement unit. The Equipment Replacement Fund will transfer $239,170 to the CIP for the replacement unit, and the Environmental Waste Services Fund will reimburse the Equipment Replacement Fund over a five-year term. Staff seeks an amendment to the 2019 CIP, providing for the appropriation of $277,170 in the Replacement of Commercial Front-Load Trucks capital project. (4) Dog Park Construction The Parks Department requested the approval of the Dog Park Construction contract with an increase to the project appropriation to address the fact that the construction bids came in higher than anticipated. On July 2, 2019, City Council authorized the construction contract for the Dog Park through a Purchasing Report. An additional $158,444 of interest earnings was applied to the project as well as a transfer of $15,000 remaining available funds from the Pool UV Filter Replacement capital project. Staff seeks an amendment to the 2019 CIP, providing for the supplemental appropriation of $173,444 in the Dog Park capital project. (5) Central Park Restroom Building The Parks Department requested the fabrication and installation of a restroom building to replace the restroom/concession building behind Ballfield #1 at Central Park, adjacent to Avenue H. The site is adjacent to the Dog Park and will have the capacity to accommodate dog park patrons, baseball leagues, and other general park patrons. On August 6, 2019, City Council authorized a construction contract for the Restroom Building through a Purchasing Report. The Sports Field/Parks Renovation Program was approved as part of the 2019 Bond Program. Staff seeks an amendment to the 2019 CIP, providing for the appropriation of $323,168 in the Sports Field/Parks Renovation capital program. (6) Winters Park Sports Lighting The Parks Department requested replacement of the existing wood poles and light fixtures at Winters Park Soccer Complex with new steel poles and LED light fixtures. On September 3, 2019, City Council authorized an installation contract through a Purchasing Report. The Winters Park – Sports Field Lighting project was approved as part of the 2019 Bond Program. The Electric Utility Fund is contributing $1,500,000 for this project through a transfer to the CIP. Staff seeks an amendment to the 2019 CIP, providing for the appropriation of $2,365,000 in the Winters Park – Sports Field Lighting capital project. (7) Construction of Waste Cell No. 8 EWS - Disposal requested construction services for the next waste disposal cell (Cell No. 8) and the remaining portion of the levee for the Phase 1 area at the Hinton Landfill. On July 16, 2019, City Council authorized construction services for Cell No. 8 through a Purchasing Report. An additional $37,120 was applied to the project from the Landfill Sinking Fund through a transfer from the General Fund. Staff seeks an amendment to the 2019 CIP, providing for the supplemental appropriation of $37,120 in the Construction of Waste Cell No. 8 capital project. (8) Trails and Bikeways Master Plan Scope Expansion The Parks Department requested to expand the previously approved Bicycle and Pedestrian Master Plan to include additional scope of work to generate a comprehensive Trails and Bikeways Master Plan of the City of Garland. On September 3, 2019, City Council authorized the Change Order through a Purchasing Report. The Trail Development Program was approved as part of the 2019 Bond Program, with initial funding appropriated through 2019 CIP Budget Amendment No. 1. An additional $10,500 was requested for the Trails and Bikeways Master Plan. Staff seeks an amendment to the 2019 CIP, providing for the supplemental appropriation of $10,500 in the Trail Development – Master Plan capital project.
CONSIDERATION
Staff seeks Council approval to appropriate $281,268 to the Stormwater Maintenance Equipment project, $163,879 to the New Landfill Roll-Off Truck project, $277,170 to the Replacement of Commercial Front-Load Trucks project, $173,444 to the Dog Park project, $323,168 to the Sports Field/Parks Renovation – Central Park Restroom Building project, $2,365,000 to the Winters Park – Sports Field Lighting project, $37,120 to the Construction of Waste Cell No. 8 project, and $10,500 to the Trail Development Program – Master Plan project. The Equipment Replacement Fund will transfer $239,170 and the Self Insurance Fund will transfer $38,000 to the Replacement of Commercial Front-Load Trucks project. The Electric Utility Fund will transfer $1,500,000 to the Winters Park – Sports Field Lighting project, with the remaining $865,000 to be funded by the 2019 Bond Program. An additional $158,444 of interest earnings will be applied to the Dog Park project, with an additional $15,000 of available funds to be transferred from the Pool UV Filter Replacement project. The City’s cash reserves will be used to fund the $163,879 required for the New Landfill Roll-Off Truck project, and a Reimbursement Certificate will be issued allowing the reserve to be replenished in May 2020 when Certificates of Obligation are issued to fund this request and the remainder of the 2020 CIP. Additionally, the City will issue Commercial Paper as expenditures are incurred in the Sports Field/Parks Renovation – Central Park Restroom Building project, the Winters Park – Sports Field Lighting project, and the Trail Development Program, and at a future date, General Obligation Bonds will be issued to refinance the outstanding Commercial Paper.

BACKGROUND
The Water and Sewer System Commercial Paper Program finances various capital improvement projects for the Water and Sewer System. Funding capacity of this program is $90 million. Due to current market conditions, the City of Garland has an opportunity to refund the $30 million of variable rate commercial paper notes with fixed rate long-term Water and Sewer System Revenue Refunding Bonds. In addition, due to current market conditions, the City of Garland has an opportunity to refund approximately $13 million Water and Sewer System Revenue Bonds, Series 2010 and approximately $11.1 million Water and Sewer System Revenue Refunding Bonds, Series 2011A. This refunding will not extend the amortization of these bonds and will generate approximately $3.48 million in debt service savings between fiscal years 2020 and 2030. The exact amount of savings is subject to market conditions between now and the final pricing date of November 5, 2019.
CONSIDERATION
The Refunding Bonds will be fixed rate debt with a 20-year amortization period. The Refunding Bonds will have a declining amortization schedule with projected annual debt service payments of approximately 1.7 million in 2020, $5.9 million between 2021 and 2024, $3.6 million between 2025 and 2030 and $1.9 million between 2031 and 2040. The projected interest rate is 2.5%. The exact amount of annual debt service and interest rate is subject to market conditions between now and the final pricing date of November 5, 2019.

BACKGROUND
Commercial Paper is a short-term debt instrument that is issued incrementally as funds are needed to finance the General Obligation Capital Improvement Program and has maturities ranging from 1 to 270 days. Interest is paid at each maturity date but principal is rolled to a new maturity date by issuing replacement commercial paper. This process continues until long-term debt is issued at a fixed rate to refinance the outstanding commercial paper. Due to current market conditions, staff and the City's Financial Advisor, Hilltop Securities, are recommending to refund approximately $23.5 million of outstanding Commercial Paper into fixed rate long-term General Obligation debt. In addition, the City of Garland has an opportunity to refund approximately $1.3 million Combination Tax and Revenue Certificates of Obligation, Series 2010. This refunding will not extend the amortization of these bonds and will generate approximately $191,000 in debt service savings between fiscal years 2020 and 2030. The exact amount of savings is subject to market conditions between now and the final pricing date of November 5, 2019.
CONSIDERATION
The Refunding Bonds will be fixed rate debt with a 20-year amortization period. The Bonds will have projected annual debt service payments of approximately 650,000 in 2020, $1.6 million between 2021 and 2030 and approximately $1.5 million between 2031 and 2040. The projected interest rate is 2.7%. The exact amount of annual debt service and the interest rate is subject to market conditions between now and the final pricing date of November 5, 2019.

This refunding transaction will not extend the amortization period of these bonds and will save approximately $19 million in debt service cost between fiscal years 2020 and 2030. The exact amount of savings is subject to market conditions between now and the final pricing date of November 5, 2019.
CONSIDERATION
The Refunding Bonds will be fixed rate debt with a 30-year amortization period. Annual debt service is projected to be $5 million in 2020, $15 to $17 million between 2021 and 2030, and $2 million between 2031 and 2050. The projected interest rate is 2.73%. The exact amount of annual debt service and net interest is subject to market conditions between now and the final pricing date of November 5, 2019.

RECOMMENDATION

BACKGROUND
The Garland Police Department has successfully participated in STEP enforcement grants for many years. The purpose of this grant is to save lives, reduce motor vehicle crashes and injuries and change behavior related to driving habits. TxDOT has changed their methodology beginning in FY2019. Rather than aggressively enforcing traffic laws specific to red light and intersection violations, seatbelt violations, speed violations and driving while intoxicated violations, grant enforcement will be focused on high visibility patrols/traffic stops within identified enforcement zones that historically have had major crashes. It is anticipated that increased police presence in these areas will change driver behavior as well as have a positive effect on crime in these zones. The enforcement activities will also be supplemented by additional public information and education campaigns throughout the grant period.
CONSIDERATION
The grant for FY 2019-2020 is in the amount of $218,844.64. If accepted, TxDOT will reimburse the City of Garland $174,999.45. The grant requires the City to provide $43,845.19 in matching funds. This will be accomplished in part through fringe benefits expenditures, TMRS contributions, vehicle mileage costs and administrative time spent on grant related paperwork. Consequently, the City can satisfy the contractual match requirements without expending any additional funds.
