NOTICE: The City Council may recess from the open session and convene in a closed executive session if the discussion of any of the listed agenda items concerns one or more of the following matters:
(1) Pending/contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct.  Sec. 551.071, Tex. Gov't Code.

(2)  The purchase, exchange, lease or value of real property, if the deliberation in an open meeting would have a detrimental effect on the position of the City in negotiations with a third person.  Sec. 551.072, Tex. Gov't Code.

(3)  A contract for a prospective gift or donation to the City, if the deliberation in an open meeting would have a detrimental effect on the position of the City in negotiations with a third person. Sec. 551.073, Tex. Gov't Code.

(4)  Personnel matters involving the appointment, employment, evaluation, reassignment, duties, discipline or dismissal of a public officer or employee or to hear a complaint against an officer or employee.  Sec. 551.074, Tex. Gov't Code.

(5)  The deployment, or specific occasions for implementation of security personnel or devices. Sec.  551.076, Tex. Gov't Code.

(6) Discussions or deliberations regarding commercial or financial information that the City has received from a business prospect that the City seeks to have locate, stay, or expand in or near the territory of the City and with which the City is conducting economic development negotiations; or to deliberate the offer of a financial or other incentive to a business prospect of the sort described in this provision. Sec. 551.087, Tex. Gov't Code.
(7) Discussions, deliberations, votes, or other final action on matters related to the City’s competitive activity, including information that would, if disclosed, give advantage to competitors or prospective competitors and is reasonably related to one or more of the following categories of information:
  • generation unit specific and portfolio fixed and variable costs, including forecasts of those costs, capital improvement plans for generation units, and generation unit operating characteristics and outage scheduling;
  • bidding and pricing information for purchased power, generation and fuel, and Electric Reliability Council of Texas bids, prices, offers, and related services and strategies;
  • effective fuel and purchased power agreements and fuel transportation arrangements and contracts;
  • risk management information, contracts, and strategies, including fuel hedging and storage;
  • plans, studies, proposals, and analyses for system improvements, additions, or sales, other than transmission and distribution system improvements inside the service area for which the public power utility is the sole certificated retail provider; and
  • customer billing, contract, and usage information, electric power pricing information, system load characteristics, and electric power marketing analyses and strategies.  Sec. 551.086;  Tex. Gov't Code; Sec. 552.133, Tex. Gov’t Code]
1. Consider the Consent Agenda

A member of the City Council may ask for discussion or further information on an item posted as a consent agenda item on the next Regular Meeting of the City Council. The Council Member may also ask that an item on the posted consent agenda be pulled from the consent agenda and considered for a vote separate from consent agenda items on the regular agenda.  All discussions or deliberations on this portion of the work session agenda are limited to posted agenda items and may not include a new or unposted subject matter.   
2. Written Briefings:  
a.   Consider Garland Cultural Arts Commission Inc. Hotel Occupancy Tax Revenue Budget, Sub-grant Recipients, and Authorize Execution of the Hotel Occupancy Tax Program Management Agreement

Council is requested to consider approving the 2018-2019 budget of the Garland Cultural Arts Commission, Inc. (GCACI), sub-grant recipients, and authorization of the City Manager's execution of the "Hotel Occupancy Tax Program Management Agreement: between the City of Garland and the GCACI.  Unless otherwise directed by Council, this item will be scheduled for formal consideration at the October 16, 2018 Regular Meeting.
b.   Campbell Road Switching Station Land Purchase

Council is requested to approve the contract for the land purchase from STREAM Data Centers DFW VII, L.P.  Unless otherwise directed by Council, this item will be scheduled for formal consideration at the November 6, 2018 Regular Meeting.
c.   Strategic Project Portfolio - Work Plan Quarterly Update

Council is receiving a quarterly update on the Strategic Project Portfolio - Work Plan.  There are currently 91 projects associated with the portfolio, and the Work Plan serves as a tool to provide Council with periodic updates on the status of each project.  The October 2018 report shows the status of projects through the end of September 2018, corresponding with the Fiscal Year calendar.
d.   Thoroughfare Plan Amendment - Zion Road

Council is requested to amend the Thoroughfare Plan to include the extension of Zion Road to the IH 30 Frontage Road as shown on in Exhibit A. Unless otherwise directed by Council, this item will be considered for formal consideratin at the November 6, 2018 Regular Session.
e.   Policy development for Tree Mitigation & Preservation Program

At the request of Council Member Deborah Morris and Council Member David Gibbons, Council is requested to begin the process of initiating a review of the City's Tree Preservation Ordinance, and begin the process of developing Tree Fund Program policies, guidelines, and administrative support.
f.   Boards and Commissions Quarterly Report

In January of 2018 the Council requested that a quarterly report from Boards and Commissions be submitted for their review.   The attached is the first such report to be prepared.  The attached is the first such report to be prepared.   • Unified Building Standards Commission
  • TIF Zone 3 Board
g.   Consider an amendment to City Council policy requiring the Administrative Services Committee to annually review ad valorem tax exemptions

Council is requested to consider and approve the attached amendment requiring an annual review of ad valorem tax exemptions by the Administrative Services Committee.
h.   Policy for Public Comments at Parks and Recreation Board Meetings 

Council is requested to approve the proposed Policy, which proposes the addition of a citizen comment period to the Board's agenda. Currently, the agenda of the Parks and Recreation Board does not include a public comment item for individuals wishing to address the Board. Unless otherwise directed by Council, this item will be scheduled for formal consideration at the November 6, 2018 Regular Meeting.  
3. Verbal Briefings:  
a.   Community Multicultural Commission Overview and Update

The Community Multicultural Commission will provide an overview of the 2017-2018 Fiscal Year.
b.   Internal Audit Committee Report

Mayor Pro Tem Rich Aubin, Chair of the Internal Audit Committee will provide a committee report on the following items:
  • Weaver Presentation - FY/2018 Annual Audit
  • Garland Women's Activities Building Council, Inc. Use Agreement Audit
  • Cash Count Audit
  • FY/2019 Annual Audit Plan
c.   Update on Progress and Implementation of Proposed 2019 Bond Referendum

Representatives from Kimley-Horn and City Staff will provide an update to the Council regarding public input, community meetings, anticipated timelines and other information related to the proposed 2019 Bond Program.
4. Regular Items:  
a.   Bond Study Committee Appointment 

In accordance with the City Charter, Article X - Section 3, the Council will consider an appointment to the Bond Study Committee.

b.   Use of Celebratory Fireworks

Council is requested to approve the amendment to Chapter 26, Police-Miscellaneous, of the Code of Ordinances which adds a subsection to prohibit fireworks.  Unless otherwise directed by Council, this item will be scheduled for formal consideration at the November 6, 2018 Regular Meeting.   
c.   Commercial and Oversized Vehicles Parked in Residential Areas

Parking issues in residential areas have become a growing concern for citizenry. Currently, city ordinance provides certain restrictions relating to oversized and commercial vehicles within residential zones; however, many citizens express dissatisfaction with the latitude provided by existing ordinances. Other citizens express contradictory views and oppose existing and/or further restrictions. 
d.   Rental Bikes and Motorized Scooters

Council is requested to consider an ordinance that would allow Code Compliance to impound unattended rental bikes/scooters.  Further, the proposed ordinance would provide for a designated reclamation period. If not reclaimed, the ordinance establishes clear authority to dispose of the property.
